Half of the nation’s Foreclosed Homes are Still Occupied

“Although one thinks lenders take losses by not moving evictions forward, they’re still faring better by keeping the properties occupied,” said Pauliana Lara of the Consumer Action Law Group in Los Angeles, which works with homeowners to fight foreclosures. “Many foreclosed homes get vandalized or squatters move in.”

5 Bankruptcy Myths Busted

Filing a bankruptcy actually increases your credit score overnight if it is already low. She has proof: Rode’s firm has a program allowing it to pull a client’s FICO scores both before and after it discharges its debt. “Usually their pre-filing score is in the high 500s, and their post-filing score is in the low 600s,” says Rode. “It immediately increases by about 30 to 50 points.”

It’s Business As Usual When It Comes to Foreclosure

According to Lauren Rode, a partner at the firm, Rosa Carrillo, of Bakersfield, Calif., entered into a repayment plan with JP Morgan Chase in December 2008. She made payments to Chase since then, totaling nearly $20,000. Chase — and this is important — accepted all of the payments. In fact, Carrillo would periodically contact Chase to see if she qualified for modification and was told repeatedly, by a bank representative, that her case was under review.

And bankruptcy accomplishes something else that surprises people, Rode says. It boosts your credit” almost immediately because it eliminates your debts, she says. But the filing remains on your credit report for eight years, which can make securing a loan to buy a house or car difficult. Filing for bankruptcy gave Davis a way out of crippling debt and onto a new life, he says. “I’ll be able to…”

What to Do if a Bank Wrongly Forecloses on You

This is perhaps the best precaution you can take to ensure that you legally have the upper hand. “Documentation is key,” said Yelena Gurevich of Consumer Action Law Group in Los Angeles, a firm dedicated to foreclosure defense. “So if someone has been paying their lender and the lender says they’re still going to foreclose on their house if they can prove that it’s wrong, the lender is essentially the bad guy in that situation.”

3 Tips for Repairing Your Credit After a Car Repossession

If you’re tempted to stop making payments because you feel misled about the condition of the car, don’t. Oftentimes an attorney can help you resolve the issue rather than having your credit dinged by a repossession. “Car-buying is very emotional,” says Pauliana Lara, also an auto fraud attorney at Consumer Action Law Group. “When a consumer goes to a dealership, they think it’s on the up and up. But when things go wrong, they’re like, ‘I don’t want to pay anymore.’ When Joe Consumer is facing a financing company and a dealership, I highly recommend that they call an attorney. We will guide them in the best way.”

Long Term Auto Loans Create Emotional and Financial Burdens

Lara said seven-year repayment terms are ridiculous, especially for used cars, but she understands why consumers turn to the option. “Desperate times call for desperate measures,” she said. Loan terms are not the only area of finance that has ballooned to meet consumer demand.

Auto Loan Repossessions Are Up – But Banks Don’t Want Your Car

Attorney Pauliana N. Lara of Consumer Action Law Group explained, “You do not have to be present in order for the bank to repossess your vehicle, so the situation could arise where you are driving your car, you are followed and once you park and leave, then the car is repossessed. It is also common to repo the car at night so long as the repo man doesn’t break the peace.”

Can I get a business loan after bankruptcy?

“They should be prepared to shop around, have a prepared explanation for what caused the bankruptcy filing and be able to demonstrate that their finances have now changed for the better,” Rode said. It will take considerable effort, but if a consumer wants to strengthen or start a business after bankruptcy, it can be done. “With the right guidance, proper explanations, strong finances since the bankruptcy, and seeking out a lender who tends to be more sympathetic … even those with tough credit predicaments will be able to secure loans,” she said.

4 times it’s not safe to cancel a credit card

“Lenders might ask, ‘Was this person ever even extended credit?'” notes Lauren Rode, bankruptcy. For consumers with just one credit card, “it’s good to use it occasionally and then pay it off,” advises Rode. This shows other lenders you are indeed able to manage credit and have a history of making on-time payments.

Do squatters actually have rights?

“You can’t be hiding, you can’t be sneaking into the place and no one knows you’re there,” said Yelena Gurevich, managing attorney at the Consumer Action Law Group of Panzarella Gurevich and Rode. She’s in California, where adverse possession can only be claimed after 10 years of continuous habitation.”
